Why yards need a written livery contract

A written livery agreement protects the yard, protects the owner and, above all, protects the horse. It sets out exactly what's included in the monthly fee, who's liable if something goes wrong, and what happens if the owner falls behind on payment.

This template works for DIY, part and full livery. Tick the correct type at the top and delete any services that aren't included in the package.

How to use this template

  1. Fill in yard name, address and the horse's details.
  2. Choose the livery type and delete the sections that don't apply.
  3. Attach your yard rules as an appendix (they form part of the contract).
  4. Both parties sign — keep the original on the yard, give the owner a copy.

4. FEES AND PAYMENT
   Monthly fee: £[AMOUNT] payable in advance on the [1st] of each
   calendar month, by [STANDING ORDER / BANK TRANSFER].

   Extras and additional services shall be invoiced separately and
   are payable within [14] days.

   Late payment: fees more than [SEVEN] days overdue may incur
   interest at [4%] above the Bank of England base rate. The Yard
   reserves the right to suspend services (other than basic feed,
   water and welfare) after [14] days' non-payment.

5. OWNER'S OBLIGATIONS
   The Owner shall:
     - Keep the horse's flu and tetanus vaccinations up to date and
       provide a copy of the passport on request.
     - Maintain the horse's worming and dental care in line with the
       yard schedule.
     - Insure the horse for third-party public liability of at least
       £[1,000,000] and provide proof on request.
     - Not bring a sick or infectious horse onto the Yard without
       first informing the Yard.
     - Comply with the Yard Rules attached as Appendix A, which form
       part of this Agreement.

6. YARD'S OBLIGATIONS
   The Yard shall provide the services in clause 3 with reasonable
   skill and care. The Yard shall take reasonable steps to safeguard
   the horse and inform the Owner promptly of any injury, illness or
   incident.

7. VETERINARY CARE
   In an emergency where the Owner cannot be reached, the Yard is
   authorised to call the horse's registered vet and to act on the
   vet's advice. The Owner shall reimburse the Yard for any vet fees
   paid on their behalf within [14] days.

8. LIABILITY
   The Yard's liability is limited as follows:
     - The Yard is not liable for injury, illness or death of the
       horse except where caused by the Yard's negligence.
     - The Yard is not liable for loss of or damage to tack, rugs or
       personal property left at the Yard. The Owner is advised to
       hold their own contents / tack insurance.
     - Nothing in this Agreement excludes liability for death or
       personal injury caused by the Yard's negligence, or for any
       liability that cannot be excluded by law.

9. NOTICE
   Either party may end this Agreement by giving [ONE CALENDAR
   MONTH]'s written notice. The Yard may end the Agreement
   immediately if the Owner is in serious breach (including persistent
   non-payment or repeated breach of yard rules).

10. LIEN
    Where fees remain unpaid, the Yard reserves the right to exercise
    a lien over the horse and any equipment on the premises in
    accordance with the Torts (Interference with Goods) Act 1977.

11. GOVERNING LAW
    This Agreement is governed by the law of [ENGLAND AND WALES /

APPENDIX A — YARD RULES
